These Terms & Conditions (“Terms”) govern your use of our software-as-a-service (SaaS) application, accessible via weatherforemail.com (the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you may not use the Service.

1. Service Description

Our Service integrates with Klaviyo APIs to retrieve profile information, fetch relevant weather forecasts, and update Klaviyo profiles accordingly. The Service does not store or persist personal identifiable information (PII) from Klaviyo or its users.

2. User Accounts

You may access the Service via:

  • Google OAuth authentication, subject to Google’s own terms of use and privacy policy.
  • Username and password, created and managed by you. Passwords are securely hashed, and you are responsible for maintaining the confidentiality of your login credentials.

3. Acceptable Use

You agree to use the Service lawfully and not to:

  • Interfere with or disrupt the Service’s functionality.
  • Use the Service to store, process, or transmit any personal or sensitive data.
  • Attempt unauthorized access to the Service or its infrastructure.

4. Data Handling

We do not store or persist any profile data or PII. Data is transmitted through secure APIs, processed transiently, and updated back to Klaviyo without retention on our systems.

Some PII Data is processed in memory, specifically the Klaviyo Profile ID and the users location information. This information is not persisted and is required in order for the service to operate.

The only profile information we retrieve is limited to:

  • Klaviyo Profile ID
  • Profile latitude/longitude
  • Profile town, city, region and country
  • Profile Locale

All Data is and will remain the sole property of the Customer/Purchaser.

5. Service Availability

We aim to provide continuous availability of the Service but do not guarantee uninterrupted operation. Scheduled maintenance or unforeseen issues may result in temporary downtime. Due to the periodic nature of how the service operates (daily updates), there will be no loss of data and it will be updated as soon as the service is back online.

6. Backups and Data Protection

Although we do not store PII, regular backups of system configurations and operational data are performed. Test restores are conducted periodically to validate backup integrity.

7. Limitation of Liability

To the fullest extent permitted by law, we disclaim any liability for:

  • Any loss or damage resulting from your use of the Service.
  • Interruptions, errors, or omissions in the Service.
  • Loss of data on the client or third-party systems.

Your sole remedy for dissatisfaction is to stop using the Service.

8. Security

We maintain security practices appropriate for our infrastructure, including secure password storage, OAuth integrations, encryption in transit, audit logs, and vendor identity management.

9. Termination

We reserve the right to suspend or terminate your access to the Service if you breach these Terms or if your use poses a security or operational risk.

10. Modifications

We may revise these Terms from time to time. Changes will be posted on our website, and your continued use of the Service after updates signifies your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of Ireland, without regard to conflict of law principles.
